These terms cover your use of this store and anything you buy from it. By placing an order you agree to them. Please read them. They are short on purpose.

1. Who we are

This store is Snow Goons, a business based in the State of Texas, United States.

Email is our only support channel. We read it and we answer it. If you message us on social media we may not see it in time.

2. Your order and when it becomes a sale

Everything on the store is an invitation for you to place an order, not a binding offer from us. Adding something to your cart and paying does not by itself create a contract.

Your order is accepted when we send you a confirmation that your order has been dispatched, or when we actually dispatch it, whichever happens first. Until then we may decline your order for any reasonable cause, including that the item is out of stock, that we cannot ship to your address, that the price or the listing was wrong, or that we suspect fraud.

If we decline your order after you have paid, we refund you in full. We do not keep a fee for a sale we did not complete.

3. Prices and pricing mistakes

All prices are shown in US dollars (USD) and are the price you pay for the goods. Any duties, import charges or taxes that your own country adds on arrival are yours to pay, and we cannot tell you in advance what they will be.

We try to get every price right. Sometimes one is wrong. If a product is listed at a clearly incorrect price, we may cancel the order and refund you in full rather than ship at that price, and we will tell you which one happened. We will never charge you more than the price shown at checkout without asking you first. If the corrected price is higher, you get the choice: pay the corrected price or take the refund.

We can change prices at any time. A price change never applies backwards to an order you have already placed.

4. Shipping

US shipping is free.

Orders leave within 1 to 3 days and usually arrive within 1 to 2 weeks.

We want to be plain about one thing, because it explains the wait: our goods ship from an overseas supplier, not from a warehouse near you. That is why the window is one to two weeks and not two days. Customs, weather and carrier delays are outside our control, so those timings are our honest expectation and not a guarantee. If your order is well past the window, email us and we will chase it.

Risk of loss and damage passes to you when the goods are delivered to the address you gave us. Please check that address before you pay. If a parcel comes back to us because the address was wrong or nobody could receive it, we will contact you to arrange what happens next.

5. Returns and refunds

Returns are covered by our refund policy, published on this store. It is part of these terms. In short, you have 30 days. The refund policy has the detail, including how to start a return and what condition goods need to be in, and if the two documents ever disagree, the refund policy is the one that governs returns.

Nothing in these terms takes away a right you have under consumer law that cannot be signed away. If your local law gives you more than we offer here, your local law wins.

6. What this product is and is not

Read this section before you buy.

Our goggles are eyewear. They are not protective equipment, and we make no impact, safety, certification or standards claim of any kind about them. We do not claim they are impact resistant, shatterproof, certified, safety rated, or tested to any standard. We make no claim about how they behave in a crash, a fall or a collision, and we make no claim about how they filter light.

We sell them on how they look and on the magnetic lens swap. That is the whole of what we say about them. Do not treat them as safety gear, and do not rely on them to protect your eyes or your face from injury.

Skiing and snowboarding carry real risk. How you manage that risk, and what equipment you choose for it, is your decision and your responsibility. If you need certified protective eyewear, buy certified protective eyewear from someone who sells it as such. We do not.

7. Using this store

Use the store for buying things and for looking at things to buy. Do not use it to break the law, do not try to get into parts of it that are not meant for you, do not scrape it, overload it or attack it, do not place orders you do not intend to pay for, and do not impersonate someone else or pay with a card that is not yours to use.

If you send us content, for example a photo attached to a support email, you confirm it is yours to send and you give us permission to use it in handling your request. We will ask you first, in writing, before we use anything you send us in our marketing.

We may refuse service, cancel orders or close an account where we reasonably believe these rules have been broken.

8. Our content

The name Snow Goons, the logo, the product photography, the videos and the words on this store belong to us or to the people we licensed them from. You may share and link to our pages. You may not copy our content to sell your own goods, pass it off as yours, or use our name or logo in a way that suggests we endorse you.

9. What we do not promise

The store is provided as it is. To the fullest extent the law allows, we disclaim all warranties that are not written down here, express or implied, including implied warranties of merchantability, fitness for a particular purpose and non infringement. We do not promise the store will be uninterrupted, error free, or free of anything harmful, and we do not promise that a product will meet a requirement we never made a claim about.

Colours on a screen are not exact. A product photograph is a photograph.

10. Limitation of liability

To the fullest extent the law allows:

• We are not liable for indirect, incidental, special, consequential or punitive loss, for lost profit, lost revenue, lost data, or for a ruined trip, a missed day on the mountain or a missed event, whether or not we were told such loss was possible.
• Our total liability to you for any claim connected with an order is limited to the amount you paid us for that order.

Some places do not allow limits like these. Where that is so, these limits apply only as far as that place allows, and nothing here excludes liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be excluded.

11. Changes to these terms

We can update these terms. The version published on this page when you place your order is the version that governs that order. We will change the "last updated" date at the top whenever we edit this page. If a change is significant we will say so on the store rather than hope you notice.

12. Governing law

These terms, and any dispute arising out of them or out of anything you buy from us, are governed by the laws of the State of Texas and the applicable federal laws of the United States, without regard to conflict of law rules. You and we agree that the state and federal courts located in Texas are where any dispute is heard.

If you are a consumer living somewhere else, this does not take away the protection of the mandatory consumer law of the place you live, or your right to bring a claim in your local courts where that law gives you that right.

13. The rest

If part of these terms turns out to be unenforceable, the rest still stands. If we do not enforce something straight away, we have not given up the right to enforce it later. These terms, together with the refund policy, the shipping policy and the privacy policy published on this store, are the whole agreement between us about what you buy here.
